These Terms of Use ("Terms") explain how you may use Tuner by Band Companion ("Tuner"), provided by Nicky Studios. For Tuner downloaded from the Apple App Store, Apple's standard end-user license agreement governs the iOS license and takes precedence over these Terms if they conflict. The Android license is described below. Band Companion is a separate app with separate terms.
Using Tuner
For Android, Nicky Studios grants you a personal, non-exclusive, non-transferable license to install and use Tuner on devices you own or control, subject to Google Play's rules. On iOS, your license is governed by Apple's standard end-user license agreement. You may not redistribute, resell, reverse engineer or modify Tuner except where applicable law allows you to do so. The app, its design and original reference-tone synthesis remain the property of Nicky Studios or its licensors.
Tuner estimates pitch from your device's microphone, offers reference tones and lets you save tunings locally. It is a practical musical aid, but accuracy depends on your instrument, microphone, environment and device. Check critical tuning by ear or with another method when necessary. Nothing in these Terms limits rights you have under mandatory consumer law.
Availability
Tuner is free to download and has no subscription or in-app purchases. Nicky Studios does not collect payment card details through Tuner.
Privacy and support
Our Tuner Privacy Policy explains microphone processing, local storage, Analytics and Crashlytics. Nicky Studios provides maintenance and support for Tuner; contact contact@bandcompanion.app. The app stores do not provide Tuner's technical support. You must also comply with any applicable third-party terms, including your device and store terms, when using Tuner.
Updates and ending use
We may release updates to improve Tuner or fix problems. Availability can depend on your device and operating system. You can stop using Tuner at any time and remove it from your device. These Terms may be revised as the app changes; a new version does not take away mandatory statutory rights. The revision date appears below.
Responsibility and legal rights
Nicky Studios is responsible for Tuner and for addressing claims about it, including product, intellectual-property, regulatory and privacy claims. To the extent permitted by law, Tuner is provided without a promise of uninterrupted operation or perfect pitch detection. This does not exclude or restrict any warranty, remedy or liability that applicable law does not allow us to exclude or restrict.
These Terms are governed by the laws of the Netherlands, without depriving consumers of mandatory protections in their country of residence. If a clause cannot be enforced, the rest of the Terms continue to apply.
